Supreme Court to Take Up OSHA ETS

Immediately after the Sixth Circuit Court of Appeals gave OSHA the right to resume enforcing employers to require employees to get vaccinated or wear a mask and be tested weekly, OSHA announced that employers will have until January 10, 2022 to be in compliance with the non-testing standards, and February 9, 2022 to be in compliance with the testing standards of the ETS.

However, challenges remain as the Supreme Court will oral arguments from petitioners and OSHA on January 7, 2022, three days before OSHA will begin enforcement efforts.
