Texas Enacts Laws on Nondisclosure and Confidentiality, AI

Effective September 1, 2025, any nondisclosure or confidentiality provisions in agreements that prohibit the disclosure of sexual abuse or assault will be voided, applying retroactively unless a court order permits nondisclosure.

Also, Texas has joined a growing number of states in enacting comprehensive AI legislation. The Texas Responsible Artificial Intelligence Governance Act (TRAIGA 2.0), which takes effect on January 1, 2026, establishes a regulatory framework for the development, deployment, and use of AI systems, with particular focus on state government operations, but it also affects private employers.
