New Protections for Pregnant and Nursing Employees

Pregnant Workers Fairness Act (PWFA):
Effective June 27, 2023, employers with at least 15 employees will be required to provide reasonable accommodations to pregnant employees and job candidates, so long as they do not impose an undue hardship on the employer.

Providing Urgent Maternal Protections for Nursing Mothers Act (PUMP):
On December 29, 2022, the Fair Labor Standards Act (FLSA) was amended to expand workplace protections for employees with a need to express breast milk. The new law also extends the available time period for such accommodations after the child’s birth from one year to two years.
